Acceptance of Terms
By engaging MacEll Electrical & Maintenance for electrical services or using our website, you accept and agree to be bound by these terms and conditions. If you do not agree to these terms, please do not use our services.
These Terms of Service ("Terms") govern your use of electrical services provided by MacEll Electrical & Maintenance, a licensed electrical contractor operating in Whanganui and the Central North Island region of New Zealand.
Description of Electrical Services
MacEll Electrical & Maintenance provides professional electrical services including but not limited to:
• Residential electrical installations, repairs, and maintenance
• Commercial electrical fit-outs and upgrades
• Industrial electrical systems and automation
• Emergency electrical services (24/7 availability)
• Solar panel installations and energy solutions
• EV charger installations and electrical vehicle infrastructure
• Security systems and CCTV installations
• Electrical safety testing and compliance inspections
• Rewiring services for homes and businesses
• Heat pump and hot water system electrical work
All electrical work is performed by licensed electricians in accordance with New Zealand electrical codes and safety standards. Specific terms for each project will be outlined in separate service agreements or quotes.
Service Scheduling and Emergency Response
Service scheduling terms:
• Standard electrical work requires advance scheduling during business hours
• Emergency electrical services are available 24/7 with priority response
• We will provide estimated arrival times for all service calls
• Delays may occur due to emergency situations or weather conditions
• Customers must provide safe access to electrical systems and work areas
• Work may be postponed if site conditions are unsafe or access is restricted
For emergency electrical services:
• Emergency rates apply for after-hours, weekend, and holiday calls
• Priority is given to safety-critical electrical issues
• Emergency response does not guarantee immediate service availability
• Additional charges may apply for emergency call-outs and urgent repairs
Payment Terms and Pricing
Payment terms for electrical services:
• Quotes are valid for 30 days unless otherwise specified
• Payment is due within 7 days of invoice date for completed work
• Emergency electrical services require payment upon completion
• Large projects may require progress payments as outlined in service agreements
• Late payment fees of 2% per month may apply to overdue accounts
• We reserve the right to suspend services for accounts in arrears
• All prices include GST unless otherwise stated
We accept payment via:
• Bank transfer (preferred method)
• Credit card (processing fees may apply)
• Cash for smaller electrical jobs
• Payment plans may be available for major electrical installations
Electrical Work Standards and Warranties
All electrical work performed by MacEll Electrical & Maintenance:
• Complies with New Zealand Electrical Code (NZECP 51:2004)
• Is performed by licensed and registered electricians
• Includes appropriate electrical safety testing and certification
• Comes with workmanship warranty as specified in service agreements
• Uses approved electrical materials and equipment
Warranty terms:
• Workmanship warranty: 12 months from completion date
• Electrical materials warranty: As per manufacturer specifications
• Emergency repairs: 90-day workmanship warranty
• Warranty does not cover damage from misuse, accidents, or normal wear
• Warranty claims must be reported promptly for assessment
Safety Requirements and Responsibilities
Customer responsibilities for electrical safety:
• Provide accurate information about existing electrical systems
• Ensure safe access to electrical panels, outlets, and work areas
• Inform us of any known electrical hazards or previous issues
• Keep children and pets away from work areas during electrical service
• Do not attempt electrical repairs while waiting for our arrival
• Report electrical emergencies immediately (fire, shock, burning smells)
MacEll Electrical & Maintenance responsibilities:
• Follow all electrical safety protocols and WorkSafe requirements
• Use appropriate personal protective equipment and safety procedures
• Conduct electrical safety testing before and after work
• Provide electrical safety certificates as required by law
• Maintain current electrical licensing and insurance coverage
Limitation of Liability
MacEll Electrical & Maintenance's liability is limited as follows:
• Our total liability for any electrical service shall not exceed the amount paid for that specific service
• We are not liable for consequential damages, lost profits, or business interruption
• Liability for electrical emergencies is limited to the direct cost of repair services
• We maintain professional indemnity and public liability insurance as required by law
• Claims must be made within 12 months of the electrical work completion
Exclusions from liability:
• Damage caused by existing electrical faults not disclosed to us
• Issues arising from electrical work performed by other contractors
• Damage from power outages or electrical grid issues beyond our control
• Normal wear and tear of electrical equipment and installations
Electrical Permits and Compliance
Electrical permits and compliance requirements:
• We will obtain necessary electrical permits for work requiring them
• Customers are responsible for building consent applications where required
• All electrical work will be certified in accordance with New Zealand regulations
• Electrical installation certificates will be provided as required by law
• We will coordinate with local councils and network companies as needed
Customer obligations:
• Provide accurate property and electrical system information
• Ensure compliance with building consent requirements
• Maintain electrical certificates and documentation
• Allow access for electrical inspections as required by authorities
Intellectual Property and Confidentiality
Intellectual property and confidentiality terms:
• MacEll Electrical & Maintenance retains ownership of our electrical design methods and procedures
• Customers retain ownership of their property and electrical installation plans
• We maintain confidentiality regarding customer electrical systems and security installations
• Technical specifications and electrical drawings become customer property upon full payment
• We may use project experience and general knowledge for future electrical work
Confidentiality commitments:
• Customer electrical system details are kept strictly confidential
• Security system information and access codes are protected
• Commercial and industrial electrical specifications remain private
• We do not disclose customer information without consent except as required by law
Termination and Cancellation
Service termination and cancellation terms:
• Either party may terminate ongoing electrical projects with written notice
• Cancellation of scheduled electrical services requires 24-hour notice
• Emergency electrical services cannot be cancelled once our electrician is dispatched
• Upon termination, all outstanding invoices for completed electrical work become immediately due
• Customer retains ownership of all electrical work completed and paid for
Cancellation fees:
• Same-day cancellation may incur call-out charges
• Emergency service cancellation after dispatch incurs full call-out fee
• Material orders for cancelled projects may be charged to customer
• No cancellation fees for rescheduling with adequate notice
Governing Law and Jurisdiction
These Terms are governed by New Zealand law, including:
• New Zealand Electrical Code and safety regulations
• WorkSafe New Zealand requirements for electrical work
• Consumer Guarantees Act protections for residential customers
• Fair Trading Act provisions for electrical service advertising
• Building Act requirements for electrical installations
Any disputes will be resolved through:
• Direct negotiation between parties as the first step
• Mediation through industry dispute resolution services
• New Zealand courts if other methods are unsuccessful
• Electrical Workers Registration Board for licensing disputes
Changes to Terms
We may update these Terms of Service to reflect:
• Changes in New Zealand electrical regulations and codes
• Updates to our electrical service offerings
• Modifications to industry standards and safety requirements
• Legal or regulatory changes affecting electrical contractors
We will provide notice of material changes by:
• Posting updated terms on our website
• Emailing active customers about significant changes
• Providing 30 days notice for major terms modifications
• Updating the "Last Updated" date on this document
Continued use of our electrical services after changes constitutes acceptance of updated terms.
